Terms and Conditions of Business
These Terms and Conditions (“Terms”) apply to all training courses, seminars and qualifications (“Courses”) provided by Delta Fire Training (“we”, “us”, “our”) to any individual or organisation (“you”, “the Client”, “the Delegate”). By booking or attending a Course, you agree to be bound by these Terms.
1. Bookings and Acceptance
1.1 All Course bookings are subject to availability and acceptance by us.
1.2 A booking is deemed confirmed once written confirmation has been issued by us or payment of an invoice has been received, whichever occurs first.
1.3 The individual attending the Course may differ from the person or organisation making the booking; however, the booking party remains responsible for payment and compliance with these Terms.
2. Fees and Payment
2.1 Course fees are as stated at the time of booking, unless otherwise agreed in writing.
2.2 Invoices are payable within the payment terms stated on the invoice, unless otherwise agreed in writing.
2.3 We reserve the right to withhold Course materials, or access to training where payment remains outstanding.
2.4 All fees are exclusive of VAT or other applicable taxes unless expressly stated otherwise.
3. Cancellations, Transfers, and Substitutions
3.1 Any cancellation or request to transfer a booking must be made in writing.
3.2 Where permitted, delegate substitutions may be accepted at our discretion, provided reasonable notice is given.
3.3 Non-attendance at a Course, for any reason, does not entitle you to a refund.
3.4 We reserve the right to apply cancellation or transfer charges in accordance with our published cancellation policy or as otherwise notified at the time of booking.
4. Course Changes and Availability
4.1 We reserve the right to amend Course content, materials, trainers, delivery method, venue, or schedule where reasonably required.
4.2 We may cancel or reschedule a Course at our discretion. In such circumstances, our liability will be limited to offering a rescheduled date or a refund of Course fees paid.
4.3 We shall not be liable for any additional costs incurred by you, including travel, accommodation, or loss of business.
5. Attendance and Conduct
5.1 Delegates are expected to attend Courses promptly and behave in a professional and respectful manner.
5.2 We reserve the right to remove any delegate whose conduct is disruptive or inappropriate, without refund.
5.3 Certain Courses may have prerequisites or minimum competency requirements, which you are responsible for ensuring are met.
6. Intellectual Property
6.1 All Course materials, including but not limited to manuals, presentations, and digital content, remain our intellectual property unless otherwise stated.
6.2 Course materials are provided for personal or internal business use only and must not be copied, recorded, distributed, or reproduced without our prior written consent.
7. Certification and Outcomes
7.1 Where a Course includes an assessment or certification element, successful completion is subject to meeting the relevant criteria.
7.2 Attendance alone does not guarantee certification unless expressly stated.
7.3 Any certificates issued remain our property until all fees have been paid in full.
8. Liability
8.1 We will use reasonable skill and care in the delivery of Courses.
8.2 To the fullest extent permitted by law, we shall not be liable for any indirect, consequential, or economic loss, including loss of profit, business, or opportunity.
8.3 Our total liability, whether in contract, tort, or otherwise, shall be limited to the Course fees paid by you for the relevant Course.
9. Health and Safety
9.1 You are responsible for ensuring that delegates are fit to attend the Course and for disclosing any relevant medical or accessibility requirements in advance.
9.2 Delegates must comply with all health and safety instructions provided during the Course.
10. Data Protection
10.1 We will process personal data in accordance with applicable data protection legislation and our Privacy Policy.
10.2 You consent to us holding and processing personal information for the purposes of Course administration and delivery.
11. Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including but not limited to acts of God, industrial disputes, or government restrictions.
13. General
13.1 If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
13.2 These Terms constitute the entire agreement between the parties in relation to the Course and supersede all prior discussions or agreements.
